Hello, my name is Benjamin Davis and I live in Bristol, VA.

I'm contacting you at this time regarding an issue I've run into at work. I work for Michael's also in Bristol. I discovered a few weeks ago that there was an employee - a fellow manager (Person A) - throwing recyclables into the dumpster. I asked her about this and she said she had a corporate accommodation not to use the compactor (recycling for cardboard). I asked the store manager about this and she said that Person A has an accommodation through corporate not to use box cutters because she has cut herself with one before. I informed the store manager that these boxes I saw her throwing away did not need to be cut down and would fit directly into the compactor. She waved this off as though I were making it up.
I decided to start leaving notes on the boxes so that she would know which ones could go into the compactor and which ones needed to be cut down first.
On Monday the 14th Person A decided to have a meeting with me about the notes. She asked that I quit leaving the notes which I did after that meeting. During the meeting, I asked her if she knew that company SOP (Standard Operating Procedure) detailed that these boxes go into the compactor even if they needed to be cut down first and that she needs to assign someone to cut them down if she cannot. She said she doesn't care that she has an accommodation through corporate. I told her that has nothing to do with her still not recycling the boxes, that the accommodation is to avoid box cutters does she not understand that it is wrong to not recycle? Person A responded with "no I don't think it's wrong I follow the Bible." to which I responded by informing her there are multiple biblical verses indicating that recycling is the right thing to do, and asked if she would like me to send her the voices. There was another manager present in the meeting (Person C) who witnessed her saying "okay" to my question.
Fast forward to Thursday the 17th wherein my store manager (Person B) gives me a final written notice that I need to stop harassing person A or my employment will be terminated. Upon calling corporate about this they have asked me to go on leave pending an investigation.

Please help me all I've done is stand up for our Mother Earth and now they are attempting to fire me for it. Many thanks for your time,

It seems that HR may have dropped the ball on this because if corporate policy is being ignored by a store management team there is a significant problem. They clearly want to stay out of any legal trouble which is why they gave the waiver to the one person, but that person probably indicated they were aware of their rights too. It would be best to have as much documentation as possible, ie names, dates, any memos, phone calls, etc. just in case. The request in writing for documentation might shake up HR enough to do something as even in a right to work state there can be no actions deemed retaliatory nature against any employee reporting such violations. Just letting them know that you are also aware of your rights may be enough, but it does not mean they will not try to do something in the future or that they would not already be planning something because you caused trouble. In any case, your best defense is publicity and local will have more effect than national in the beginning. The local news stations usually have the investigative reporter who will contact the corporate entity to get their side of the story, which they clearly want to be good and this would never be good for them.

Recycling aluminum works because a buck can be turned doing it. All other recycling is a waste of time, effort, and money. Most companies put on a front of "green policies" as PR. Nothing more. My advice is stop harassing person A, and person B will be happy. That is if you wish to remain employed. Here is the thing. If you wish to recycle and other things knock yourself out. The minute you start trying to force feed it to others that's when the problems start.

As usual Milton either did not read or could not comprehend what had been presented because of his glaring political biases. The company HAS a recycling program in place. The fact is that many companies must recycle or pay hefty fees for placing recyclable products in the waste stream thereby unnecessarily taking up space in landfills. Thus, that employee, while ignoring the company policy may also be costing the company money, which IS one of the things Milton dislikes above all.
