Wayne - I think all the things you mentioned could easily be handled by allowing each adult to choose their own "next of kin". I can't imagine why that isn't law, and it really needs to be. Seems pretty basic.

SD - I don't think the state has any interest at all in providing tax breaks. Individuals have an interest in getting tax breaks, but the state is actually harmed by providing that. The only reason to give tax breaks is if you get something of real value back - as in the case of parents, there is a compelling interest in getting the parents to marry, and keeping them married. So there are tax incentives.

It may be that society benefits when gays marry, also. Maybe married gays benefit the state - fewer car accidents, better mental health, better employment records, increased ability to buy real estate, etc.

That's the direction they need to go, in my opinion, if they want the state to sanction their union. They need to show, as in heterosexual couples, that society - not just the individual - benefits.
