In U.S. v. Cruikshank (1876) the ruling was in line with the right to bear arms pre-existed the Bill of Rights and Constitution and as such the 2nd Amendment only prevented the Congress from infringing upon that right.

The second and tenth counts are equally defective. The right there specified is that of "bearing arms for a lawful purpose." This is not a right granted by the Constitution. Neither is it in any manner dependent upon that instrument for its existence. The second amendment declares that it shall not be infringed; but this, as has been seen, means no more than that it shall not be infringed by Congress. This is one of the amendments that has no other effect than to restrict the powers of the national government, leaving the people to look for their protection against any violation by their fellow-citizens of the rights it recognizes, to what is called..."internal police."

right WAYNE....I haven't been keeping up on this like I tend to do with gun issues but it seems that they are saying that the right to keep and bear arms is much the same as the right to life liberty and the persuit of happiness...it is a right that we inherently have NOT one guaranteed or given via the constitution. The argumant is that the 2nd amendment simply points out the fact that we have that right and that neither the federal or state government has any right or ability to infringe upon that.
