Almost a decade after he was sentenced to death for the kidnapping, rape and killing of 9-year-old Jimmy Ryce, Juan Carlos Chavez will be back in court today arguing that his trial attorneys failed him.Now that Chavez, 39, has exhausted his direct appeals, his attorneys are trying to persuade a judge to overturn his conviction and death sentence by saying he had ineffective assistance of counsel. Criminal defense attorneys said the legal strategy is routine and not likely to succeed; Jimmy Ryce's parents say it prolongs their wait to see Chavez executed.
It seems like it never ends," Don Ryce said. "We understand that part of the process is to make absolutely sure in a capital case that a person is guilty and you're doing the right thing, but this is ridiculous. Our son was killed over 11 years ago. We're just now getting around to Round 2."
People who are in jail for a long time have nothing to do but come up with ways to get out," he said. "They all want to find something that's wrong that happened in their court proceedings."

One of many comments at the end of article:
im all for executing within 30 days of a guilty verdict - hey, it worked with Sadam. personally, id rather never see or hear about this piece of garbage ever again other than to hear that he's dead. let's give him as much consideration as he gave that poor little innocent kid that he butchered. seriously, this guy is an animal. call a vet and have him euthanized already!
